Power of Attorney
Lasting Powers of Attorney were introduced from the 1st October 2007 and replace Enduring Power of Attorneys.
There are two types of Lasting Power of Attorney (LPA) which can be created, they are:
- Property & Affairs; and
- Personal Welfare.
A Power of Attorney allows the creator (the Donor) to allow another person or persons to manage their affairs on their behalf in circumstances where they lack capacity to make their own decisions or are physically unable to do so.
Other decisions which can be taken on behalf of someone could include the decision on medical treatment in the event that the donor is unable to make decisions themselves.
A valid LPA can only be used once registered with the Office of the Public Guardian. To discuss whether an LPA is suitable for your needs please contact us.
Although the old style Enduring Power of Attorney cannot be created an existing one can be registered. Sanders Witherspoon can guide you through the procedure for registration.
