WelcomeCourt of Protection

In circmstances where a family member or loved one is unable to make decisions for themselves due to a lack of menatl capacity you may wish to assist them. It may not be possible for a Lasting Power of Attorney to be drafted and there may be no Enduring Power of Attorney in existence which can be registered.

Where this is the case a person can apply to the Court of Protection to become appointed as a Deputy. A Deputy performs a similar role to an Attorney and will be able to deal with the property, finances and affairs of a Donor. One of the main differences is that only a single deputy can be appointed and must do so by application to the Court of Protection; if a Donor appoints an Attorney they can choose more than one if they wish and it will be at the Donor's wish.

Sanders Witherspoon can assist with the application to the Court of Protection and ensure that you can assist your loved ones when they need you.
