Probate Claims

For many years, we, at Sanders Witherspoon LLP, have helped Clients with claims arising from the death of family members and other loved ones.

These claims involve challenging Wills or how the Estate of a deceased may pass under the rules of Intestacy. In conjuncture with our Probate Department, Clients’ interests have been protected by Caveats and losses avoided by obtaining limited Grants to call in Estates where assets are diminishing.

The provisions of the Inheritance (Provision for Family and Dependents) Act 1975, as amended, have extended the right to claim from the Estate of the deceased to children, wives, unmarried partners, civil partners and other persons who have been maintained by the deceased.

Such claims can be funded in a number of ways (please refer to “Funding Civil Claims”).
