No Insurance

The offence of driving without insurance is classed as a ‘strict liability’ offence. This means that if you were driving without a certificate of insurance in force, there is no legal defence available to you. However, that is not to suggest that the sentencing exercise by the Court is straight-forward. Although the offence carries 6 – 8 penalty points and a discretionary disqualification, mitigating factors could help to persuade the Court to follow a more lenient avenue, and, depending on the circumstances, you may have grounds to support a special reasons argument, which, if successful, would mean that the Court may not impose any penalty points or disqualification at all.
